The next step is to establish that the vessel owner is eligible to own a Cayman-flagged vessel. It involves verifying the ownership structure and confirming that the owner holds clear legal title to the vessel.
At this stage, an authorised person must be appointed to manage the Cayman Islands Yacht registration process. It needs to be mentioned here that if the vessel owner is not a resident or the owning company is incorporated outside of Cayman, a Cayman-based representative person must be appointed, who acts as the local point of contact for legal documents and communications under Cayman law.
Once ownership and representation are confirmed, the next step is to submit the required registration forms, documentation, and payment of the applicable fees. The forms and documents can be submitted either as originals or electronically.
Note - If submitted electronically, they must be accompanied by an Undertaking (Form CISR 856 – Section 5 iii) committing to submit the original or certified hard copies within 7 days.
Once all required documentation and fees have been received and verified, the Certificate of British Registry (COBR) will be issued by the Cayman Islands Shipping Registry. Additionally, a Carving & Marking (C&M) note will be provided which outlines the required identification markings for the vessel.
Once the Carving & Marking (C&M) note has been issued, the vessel must be marked in accordance with the specifications provided. This includes engraving or painting the official number, port of registry, and vessel name in a prescribed format and location which is inspected by an authorised surveyor. Post inspection, the surveyor must sign the C&M Note to confirm compliance and submit it electronically within 21 days. The original hard copy must follow within 7 days thereafter.
